3. Financial and future activities
Modu Mayo Franchise Finance (Pty) Ltd is a separately incorporated Group company (registration 2026/676002/07, per its CIPC certificate). This corporate website makes no public loan offer, financing decision, financial return promise, franchise award or regulated investment solicitation.
DTC sites, an expanded Gauteng trading network and any future alternative Fresh Produce Market are proposals/strategic ambitions requiring separate capital, premises, municipal, operational and legal approvals. No location is represented as an operating or committed Fresh Produce Market site. Descriptions of future initiatives should not be interpreted as promises of dates, permits, ownership, financing or outcomes.
4. When statutory e-commerce disclosures apply
ECTA section 43 imposes a supplier information regime for qualifying offerings through electronic transactions. It may require, as applicable, the supplier's full legal name/status, physical address and phone, website/email, office bearers and registration details, legal service address, relevant accreditation/codes (if any), description of goods/services, prices including all costs/tax, payment, downloadable terms, delivery period, record-access method, returns/refunds/dispute methods, payment and privacy safeguards, and relevant cooling-off information. Section 43 also requires a chance to review, correct and withdraw before order placement.
Any electronic sales activity falling within these requirements must provide the relevant disclosures through the actual seller on the legally appropriate surface or channel before contracting. The corporate overview does not replace the seller's transaction-specific information.
Under ECTA section 42, exceptions to section 44 cooling-off include specified household/office food deliveries and some rapidly perishable goods. This is not a blanket exemption from ECTA section 43, food standards, POPIA or otherwise applicable CPA rights. Any returns policy must reflect the applicable law and transaction circumstances.
CPA: Applicability depends on actual buyer type and statutory thresholds; bulk/B2B transactions are not all automatically exempt. A natural-person buyer may receive applicable protections; different rules can apply to larger juristic-person buyers. No general waiver is permitted.
VAT: The VAT Act section 65 governs how a registered or otherwise liable vendor must show/quote prices for taxable goods, including appropriate VAT-inclusive statements or lawful breakdown. Any applicable vendor status, product tax codes and VAT treatment must be correctly disclosed by the actual seller; this website does not state a TradeCo VAT registration number.
5. Customer service, quality and complaints
Live food supply must comply with applicable food handling, premises and transport requirements, including R638 and any applicable licences/authorisations. No certification, licence or facility is represented as approved solely by inclusion on this corporate website.
A customer should receive a clearly identified seller, accepted order/quote and applicable claims process. Actual pricing, weights, tax treatment and food handling must comply with applicable legislation and the seller's agreed trading terms. Actual customer transactions require appropriate delivery, food safety, complaints and returns arrangements; this legal information page is not the contract of sale.
The appropriate contacts for complaints, returns, faulty food and product safety must be specified by the actual seller; these enquiries should be directed to the identified TradeCo seller through the published bulk-supply contact. A website legal notice does not replace written sales terms or statutory remedies.
6. Corporate legal and information rights
Requests about this corporate website and HoldCo records: info@modumayo.co.za (shared Group contact). Personal information: see the website Privacy Notice. Access to company records: see the HoldCo PAIA Manual. Complaints and statutory rights: relevant South African regulators and courts retain their lawful jurisdiction and remedies.
No statement here makes the legal email the exclusive means of court service, creates a blanket commercial confidentiality exemption, removes statutory responsibility from subsidiaries, or represents any statutory appointment or certification not expressly evidenced.
